Why should I make a will?

Making a will allows you to make provisions for your wishes to be carried out as you want.

With a Will:

  • You can stipulate who receives your possessions and money
  • You can ensure that a charity of your choice receives a gift
  • You can give instructions on who you wish to be guardians of any children you have under 18
  • You can stipulate who you want to be the executor (the person to be responsible for making your wishes happen)
  • You can provide instructions for the welfare of any animals you have
  • You can make plans in the event of your surviving spouse re-marrying
  • You can set up a Will trust to ensure effective tax planning is put in place.

For estates with tax assets over £300,000, or £600,000 for married couples and civil partners, a Will Trust can ensure you use the nil rate band for Inheritance Tax purposes.

What can happen if I do not make a will?

  • If you are living as partners then your surviving partner will not receive anything. Your children will inherit the estate, followed by your brothers and sisters. This may not be ideal and may be unfair to a surviving partner. (For example, in the case of a woman living with her partner where the house is in the sole name of her partner, the house goes to his family unless she can show contribution.)
  • You do not control who gets your possessions
  • Your estate could be liable for too much tax
