Criminal Defence case in a cash forfeiture matter where the amount retained by the Crown was significantly reduced: Police-v-M

David Phillips and Partners criminal solicitors represented M in cash forfeiture proceedings under the Proceeds of Crime Act 2002 (“POCA”). As a result of our involvement the amount retained by the Crown was reduced from 150,000 Euros to 40,000 Euros.
M was stopped by the police and his vehicle searched. During the search 150,000 Euros were found in his car. He explained to the police that he had the money changed by a broker to fund a property purchase in Spain. The police did not accept this and seized the money under POCA.
M instructed David Phillips and Partners’ criminal defence solicitors in respect of the forfeiture proceedings. We advised M on the law and what was required of him to prove his version of events. We also dealt with the proceedings.
As a result of the advice and representation provided by David Phillips and Partners criminal solicitors, the police and court accepted M’s right to retain 40,000 Euros.
