Actions against the police claim for wrongful arrest and false imprisonment: P.C.-v- Her Majsty’s Court Service (HMCS)

P.C. successfully pursued a claim for compensation against HMCS for wrongful arrest and false imprisonment.
He was arrested by the police at 11.30p.m. on 12th August 2007 on the grounds of there being a live warrant for his arrest. He told the police that this matter had been dealt with previously at court, but was still was detained in a police cell overnight for 12 ½ hours.
He was taken to the Magistrates’ Court where it was established that P.C. had been telling the truth, and that the Court had failed to update the police national computer to confirm that the warrant was no longer live.
P.C. instructed David Phillips and Partners solicitors to pursue an action against the police for wrongful arrest and false imprisonment.
David Phillips and Partners solicitors settled P.C.’s claim for £2000 for damages for wrongful arrest and false imprisonment.
