Criminal Defence in a business fraud case involving investigations in Spain for the defendant’s benefit: R-v-S

S instructed David Phillips and Partners criminal defence solicitors to assist in his defence in theft charges. As a result of our criminal lawyers’ work he avoided a custodial sentence.
S was alleged to have set up a company with another person and then stolen tens of thousands of pounds from it. The original company was based in Norfolk, England, but more related companies were set up in Spain. It was alleged that the other person involved in the company was the money behind it, and that S had stolen money from him as shareholder in the Norfolk business and transferred it to Spain.
S denied the charge, explaining that any transfers had been done to assist the businesses, and that the charges were being brought because the parties had fallen out.
David Phillips and Partners criminal defence solicitors went to Spain to investigate and take statements from relevant witnesses the police had overlooked. As a result, S avoided a recommended sentence of 3 years in custody.
